Halloween is supposed to be scary.
Ghosts. Zombies. Vampires. Haunted houses. That guy who thinks wearing a banana costume makes him irresistible. But there is one Halloween fright that nobody puts on their party invitation: Getting arrested for DUI. You can dress like a zombie, but you probably don’t want to spend the night with one—especially if the zombie is sitting in a jail cell next to you.
The Halloween Party Problem
Halloween parties often come with alcohol. Maybe you’re having a couple of beers with friends. Maybe someone serves a mysterious punch that contains enough alcohol to resurrect Dracula. You feel fine. You laugh. You eat some pizza. You decide you’re perfectly capable of driving home. That’s where Halloween can turn from fun to frightening.
California law does not require you to be falling-down drunk before you can be arrested for DUI. A driver’s ability to operate a vehicle can be affected by alcohol even when the driver doesn’t feel particularly impaired. And once the police stop you, the Halloween costume may become the least interesting thing about you.
“Officer, I’m Dressed Like a Pirate!”
Unfortunately, telling the officer that you’re a pirate doesn’t give you a license to sail your car home. Neither does saying:
- “I only had two drinks.”
- “I feel completely fine.”
- “I’m a really good driver.”
- “I’ve driven home like this before.”
- “I’m only five minutes from my house.”
Those statements aren’t likely to make the situation disappear. And whatever you do, don’t assume that because you’re wearing a costume, the police won’t take the stop seriously. They will.
The Truly Scary Part
A Halloween DUI can create consequences that last much longer than Halloween night. Depending on the circumstances, a DUI arrest can involve:
- A criminal court case
- Possible Jail
- DMV license issues
- Fines and court costs
- Increased insurance expenses
- Alcohol education requirements
- Possible probation
- Ignition-interlock requirements in applicable cases
- Potential employment consequences
In other words, the ghost costume comes off the next morning. The DUI case may not.
The Best Halloween Trick
Here’s a Halloween trick that actually works: Don’t drive after drinking. Have a designated driver. Use a rideshare service. Get a ride from a friend. Stay where you’re partying. Plan your transportation before the first drink—not after the last one.
And remember, “I think I’m okay to drive” is not a transportation plan. Halloween shouldn’t be about explaining your costume to a judge while wearing something considerably less comfortable than a vampire cape. Have fun. Be safe. And if alcohol is involved, make sure your ride home is planned before the party begins. Because the scariest Halloween story isn’t “The House That Haunted Me.” It’s: “The Night I Thought I Was Fine to Drive.”
