- Misdemeanor hit and run (Vehicle Code 20002 VC) happens when there is property damage only. Penalties can include up to 6 months in county jail, fines of up to $1,000, restitution for damages and two points on your DMV record.
- Felony hit and run (Vehicle Code 20001 VC) applies when someone is injured or killed. The penalties can include possible state prison up to 3 years or 4 years if serious injury or death, fines between $1,000 and $10,000, additional time if DUI is involved, suspended license and civil lawsuits from victims.
The severity of the penalties drivers may face depends on whether the injuries were minor or serious.

Generally, drivers can legally leave the scene of an accident only after stopping their vehicle immediately, exchanging contact and vehicle information with other involved parties, providing assistance to injured individuals and notifying law enforcement. Could Drivers Face Charges For A DUI And A Hit and Run?
Yes. Drivers can face both DUI and hit-and-run charges. However, timing is critical for DUI cases. Police must locate the driver quickly enough to conduct chemical tests and prove the driver’s BAC (blood alcohol or drug level) at the time of the crash. Without timely chemical tests, it becomes harder for prosecutors to also prove drunk or impaired driving.
If the driver is not found within a few hours, the defense could also argue that any impairment was caused after the accident. This can create reasonable doubt about whether the driver was under the influence during the crash, making DUI charges much harder to stick.
