What To Expect In A California DUI Case

Getting arrested for DUI in California can feel confusing and intimidating. Many people assume it’s just “one case,” but a DUI actually involves multiple proceedings including criminal Court and DMV.  Each has its own rules, timelines, and consequences. Understanding how these pieces fit together can make a huge difference in addressing your case and your future.

Below is a step-by-step breakdown of the criminal side of a California DUI case, from arrest to resolution.

1. The DUI Arrest

A DUI case begins with a traffic stop, accident or DUI checkpoint. After observing signs of impairment, an officer may:

  • Conduct field sobriety tests or field breath tests
  • Place you under arrest for DUI
  • Administer a breath or blood test (the official test is usually at the station or jail after arrest)

Once arrested, you’ll typically be booked, fingerprinted, and either released on bail or given a promise to appear in court.  If not released, you will appear in front of a Judge within 3 Court days for the Arraignment.

2. The Criminal Complaint (Filing of Charges)

After the arrest, the police report is sent to the District Attorney’s (DA) Office. The prosecutor reviews the evidence and decides whether and what formal charges to file. Generally, the same charges you were arrested on are filed, but based on the evidence or additional information the DA can add or delete charges. Sometimes the blood result is not completed in time for filing and you may be notified of a new Court date after the reports or information is forwarded to the DA.

The filed charge is described in the criminal complaint and will specify whether the charge is a misdemeanor or felony and if there are any enhancements (high BAC, accident, prior DUIs, Refusal etc.).  Charges can be filed days or even weeks after the arrest. The charges for a misdemeanor DUI must be filed within 1 year and within 3 years for a felony DUI. DUI cases without injury of another are misdemeanors unless this is your 4th DUI in 10 years.

3. Arraignment

The arraignment is your first court appearance in the criminal DUI case. On misdemeanors in California, an attorney can appear for you.  (If it is a felony then you must appear with your attorney.)  At this hearing the judge formally advises you of the charges, you enter a plea (not guilty, guilty, or no contest) and bail or release conditions may be set or modified. Most DUI defendants plead not guilty at arraignment so their attorney can review evidence and begin negotiations, settlement discussions, and see if the case can be resolved without trial with lesser penalties or charges. (Most cases are resolved without trial.)

4. Pretrial Proceedings

This is often where the real work in a DUI case happens.

After your arraignment, your attorney will conduct an investigation. He or she obtains and analyzes, police reports, initial contact, any bodycam and dashcam footage, breath or blood test results, calibration and maintenance records of the testing equipment.

At your initial meeting with your attorney after receipt of the reports, he or she will review the facts of your case, DMV and Court proceedings, possible defenses and resolutions.

Your attorney will also tell you things that can be done to help get the best resolution in your case like getting in the required DUI Class right away, attend a DUI Victim Impact panel on line, attend AA meetings or treatment if appropriate. Getting a resume with your education, background and career information can also be helpful as well as any of your personal achievements in your life.  If you are a veteran or active-duty military there are special programs, like military diversion, you may qualify for that can result in a dismissal.

Negotiations

Most DUI cases are resolved during pretrial settlement discussions via plea bargain (which often reduces penalties, dismisses sentence enhancements like high blood alcohol level (BA), or reduces charges to a “Wet Reckless”). The defense attorney will determine what a best-case settlement would be for your case and attempt to get that resolution by noting weaknesses in evidence as well as providing mitigating information like DUI program enrollment, AA or DUI Victim Impact panel attendance, beneficial resume information, or impacts to immigration status if applicable.

5. Trial (Only If the Case Does Not Settle)

Most cases settle through negotiations but, if no resolution is reached and you have a defense, the case may proceed to trial.  The prosecution must prove guilt beyond a reasonable doubt. The defense can challenge the stop, testing, and officer credibility. Expert witnesses may also testify about forensic testing or scientific issues during your trial. DUI trials are usually jury trials, but can be bench trials (judge only), depending on the case.

6. Sentencing

If there is a guilty plea or conviction, the case moves to sentencing. If you negotiated a plea bargain, you already know what sentence or penalties you will have to abide by. If there was a conviction at trial, possible penalties you could face may include any of the following:

  • 3-5 year probation period with terms of the probation
  • Possible Jail time
  • Alternative sentences (such as public work or electronic detention)
  • Fines
  • DUI education programs
  • Driver’s license suspension
  • Ignition Interlock requirement

Criminal Court vs. DMV Proceedings

It’s critical to understand that the criminal DUI case is separate from the DMV administrative process. You can win one and lose the other.

For instance, the DMV has separate license suspension proceedings that are initiated with the Pink Sheet Notice of Suspension given to you at the time of your arrest. The DMV pink Notice of Suspension requires immediate action within 10 days of your arrest to challenge and delay the administrative suspension that will otherwise take effect 30 days after arrest.

Handling both your DUI case and the DMV requirements correctly —and on time — is essential and a skilled DUI defense attorney usually handle both. The earlier a defense attorney gets involved, the more options are typically available to address the case and your license issues.
