New 2019 DUI License suspension laws change previous license suspension laws. There are usually 2 types of driver license suspensions which occurr in a 1st offense DUI case. There is the 4 month pink sheet administrative suspension for individuals 21 and over with a .08 Blood Alcohol (BA) level or more and the 6 month suspension triggered by a DUI conviction. The pink sheet admin suspension required a one month “NO DRIVING” suspension before you could convert the 4 suspension to a 5 month restriction for work and DUI programs. DUI cases with the arrest after January 1, 2019 are now allowed to get a restricted license right away without the 30 day no driving suspension period before applying.
New 2019 DUI License suspension laws state if you install an IID (Ignition Interlock Device) you can immediately get a license if there is a suspension either the DMV admin suspension or Court conviction suspension. You will still have to be signed up for the California DUI program, have an SR-22 Insurance form on file and go to DMV and pay a reissue fee. With an IID for 6 months, there are no other restrictions for driving, you are no longer limited to work and program related driving. An IID is installed in your ignition system, you blow into it to start you car and it will not allow the vehicle to start if any alcohol is detected. New laws also allow for an IID restricted license for 2nd, and 3rd offense cases as well as Felony DUI with Injury cases.
There is another alternative for 1st offense DUI defendants, instead of installing the IID, there is the immediate availability of a restricted license only for work and DUI programs for 12 months. You will still need to be in the DUI program, have an SR-22 on file and pay a reissue fee.
