Prop 64 Legalizing Marijauna and its impact in Vista Courts

On Behalf of | Nov 15, 2016

Prop 64 legalizing Marijuana does much more than just legalizing the recreational use of Marijuana.  It also provides an opportunity to clean up your prior record if you had prior marijuana related misdemeanors or felonies in Vista Courts and throughout California.  Prop 64, which just passed, is primarily known for legalizing recreational marijuana use and possession for individuals 21 and over, however, it also reduces or eliminates criminal penaltiies for possessing, transporting, and growing marijuana so long as it is done in compliace with this new law.

Prop 64 legalizing marijuana details regulation, licensing, taxation, allocation of government revenue, and reduction of criminal penalties.  Adults 21 and over are authorized possession, transport, purchase, consumption and sharing of up to ONE ounce of marijuana, up to EIGHT grams of marijuana concentrates and growing up to SIX plants per household out of public view.  The law applies retroactively and allows individuals with Marijuana related prior felonies and misdemeanors to petition the Court to reduce or remove the convictions from their record in accordance with the new law.

Prop 64 legalizing marijuana makes recreational pot legal right away, some of the provisions will take some time to implement.  It is important to read the new law so that you understand it and can avoid violating the new law which does still have criminal sanctions for violations.  You can benefit by contacting a Criminal Defense Attorney if you have a case pending or a prior marijuana misdemeanor or felony which could be reduced or eliminated from your record. Call Christoph Law Offices at 760-941-5720 for a free consultation if you have any of these issues.  Located across from Vista Courts for over 34 years, we provide the highest level of personal and professional represntation.
