What is the DUI Pink Sheet Suspension Notice?

On Behalf of | Jan 1, 2016

The DUI pink sheet suspension notice you get when you are arrested is also a temporary license for 30 days if your license was valid at the time of the stop.  It is extremely important that you read pink sheet.  It tells you that a suspesnion of your drivers license by DMV will take effect in 30 days from your arrest, regardless whether you have been to Court or convicted.  This suspension is in addition to any suspension arising from a conviction for DUI and the length of the suspension depends on the reason for the suspension and prior DUI history.

The form at the top has the date of the arrest and a check mark in the box that the suspension is based on, for instance – diving with .08 or more blood alcohol level, refusing a chemical test, driving with .01 or more under 21 years of age or on probation etc.  It also tells you that you can challenge that suspension by contacting the DMV WITHIN 10 DAYS of the arrest and setting up a hearing.  Failure to call DMV to set a hearing within 10 days waives your right to challenge the suspension.  Normally an experienced DUI attorney will set up and handle the DMV licensing hearing if he is contacted in time.  That is why it is so important to atr least contact an experienced DUI attorney to discuss your case and educate you on the licensing issues before the 10 day deadline is up.

By setting the hearing, no suspesnsion will take effect until after a hearing which may bew albe to be done without you there, depending on the issues.  Setting the hearing also allows an extension of your license beyond the 30 day period and usually 1 to 3 weeks after the hearing.  Reports are sent to the Attorney before the hearing and also allows the case to be reviewed before the Court date.  Even if you loose the hearing, you will have a license 45-60 days or more rather than the 30 days without a hearing.  Call Christoph Law Offices for a free consultation at 760-670-3885.  Experienced DUI Attorneys Nicholas and William Christoph have been across from the Vista Courts for over 30 years, helping people charged with DUI get the best possible resolution.
