California (Penal Code) PC 1001.80 veterans diversion is a new law which is a huge benefit to veterans and active duty military personnel charged with misdemeanors and who qualify. This law allows a veteran or active duty defendant to participate in a diversion process without entering a plea of guilty or ever having a conviction for a misdemeanor if that veteran was suffering from a military related mental health issue per this code section, including but not limited to sexual trauma, traumatic brain injury, post traumatic stress disorder, substance abuse or other mental health issue.
The specific proceedures and rquirement by local San Diego Courts are still being set up for PC 1001.80 veterans diversion. This diversion can result in the suspension of prosecution for 6 months to 2 years with local treatment and educational resources utilized to address underlying mental health issues like PTSD at the local level. VA programs, counseling and other resources could greatly assist veterans with thes issues. It does not matter if the veteran actually served in combat, however, combat service clearly may make qualifying easier for the program. This diversion is available before trial, but some individuals may prefer to not commit to it and proceed with other ways to resolve their criminal case depending on their individual situation.
If you are a veteran and have a misdemeanor criminal case in California, it is an important option to be considered. Each veteran’s situation and career goals varies, and the benefits of the program and “no conviction” may be important if qualified for the program.
