Drug DUI offenses are not eligible for Diversion also known as PC 1000. The law excludes these offenses for treatment in lieu of prosecution in North County and all of California. Drug DUIs are treated similarly to alcohol DUIs with probation, fines, programs and possibly custody or an alternative to custody like public work or community service. Every jurisdiction may treat these offenses slightly differently so it is important to hire an attorney who practices regularly in the Court where your case is being heard.
Local attorneys tend to know exactly how the these cases are handled, which District Attorney’s and Judges may be more favorable to negotiate with or plead in front of. Knowing the law is important, but also knowing your way around the Courthouse is equally important. Drug DUI cases involve prescription medication as often as illegal drugs. It is not whether the drug is legal or illegal in a DUI case, it is whether you are impaired for purposes of driving regardless whether its heroin or prescription vicodin. There are more issues as to what blood levels of various drugs may impair a person for driving.
