Getting a License Back After First DUI

Getting a license back after a first DUI is a multistep process.  If you had a valid license at the time of the arrest it remains valid until there is a 6 month suspension triggered by a conviction for DUI and usually a second administrative DMV suspension for 4 months for being .08 or more BA (blood alcohol).  These 2 suspensions can run at the same time concurrently.

You are eligible to get a restricted license in each case in the same way and at the same time provided both suspensions show in effect in the DMV Computer.  Sometimes these suspensions can start at different times or be inputted in the DMV system at different times.  It is important in order to cure both suspoensions that they both show up in the system in order to get the restricted license.

There are two restricted licenses available, one reststriction requires you drive only a IID (Ignition interlock device) installed but allows you to drive anywhere at anytime for any reason as long as you are driving the IID Vehicle for 6 months.  The second restriction is avialble without the IID but requires you wait 30 days after suspension and is restricted to/from and in the course of your employment or  school/DUI Program.

You must go to DMV in order to get the restricted license, but DMV must also have correspondence from the DUI program that you are enrolled and an SR 22 confirmation of coverage must be filed with DMV by you insurance company.  Then, if both suspensions show up in the DMV system, proof of program and SR 22 are also showing up in the system, you go to DMV and pay a reissue fee of about $145.  If you are getting the IID restriction – drive anytime, you must also bring in a certificate of IID nstallation when you go to DMV.
