Marijuana DUI Cases are Expected to Increase in North County

Marijuana DUI cases are expected to increase in North County based on the legalization of recreational Marijuana for sale as of January 2018. Law enforcement in Oceanside, Carlsbad, Vista and throughout north county is gearing up for the challenge of prosecuting the projected increase in Drug DUI cases as a result of this. More officers are being trained as Drug Recognition Experts (DRE) to recognize impairment in drivers other than or in addition to alcohol.

Blood analysis in a Marijuana DUI case provides quantative information concerning active and metabolized THC in the system which coupled with driving, field sobriety tests, and officer observations can help determine whether an individual is under the influence of a drug and/or alcohol. As the science, empirical data, and field experience increases so will the success in prosecuting those impaired fro purposes of driving. It will be interesting to review law enforcement statistics at the end of the year to get a feel for the impact the legalization of marijuana has had on DUI arrests, convictions, accidents and fatalities.

Marijauna DUI cases, Drug DUIs, or alcohol DUIs all potentially pose a serious public safety issue which education and enforcement should address to keep our highways safe. If you have been arrested for a DUI, contacting a DUI lawyer early on will at least provide you with an overview and understanding of what you are up against and possible resolutions.
