Expungements Can Help Clean Up Your Record for Employment

Expungements in California refer to California Penal Code 1203.4 et seq. and can help clean up your record in many ways, including employment.  An expungement in California is the withdrawal of a guilty plea and dismissal of the case for most purposes per California Penal Code 1203.4 et al.  It is available on infractions, most misdemeanors and many felony convictions where there was no prison commit.  The motion to expunge is filed, served on the D.A. and a Court hearing date can usually be set in 4-6 weeks in Vista Courts.

California Labor Code 432.7 states that an expunged offense be asked about, seek information about or use it to hire, fire, promote or terminate employment.  There are some exceptions like law enforcement employment. If you are still on probation, a motion to terminate probation early may also be filed with the expungement request.  If you were not on probation, then there is a one year waiting period from conviction before you can request PC 1203.4 relief.  Additionally, many felonies may be reduced to misdemeanors and expunged which removes the felony conviction from your record as well as expunging the offense.  This may restore gun rights as well as help in many other ways like immigration, security clearances, occupational licenses, educational opportunities.
